Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Lega platform (the "Service") operated by Polygon Technology Solutions("Lega", "we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least eighteen (18) years old and capable of forming a binding contract under Malaysian law to use the Service. By using the Service, you represent that you meet these requirements.

2. The Service

Lega is a multi-channel customer relationship management (CRM) platform that connects to WhatsApp, email, web chat, and web forms, providing a unified inbox, lead pipeline, AI auto-reply, bulk messaging, and related features. We may add, modify, or remove features from time to time.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately of any unauthorised use.

4. Subscription and Payment

Access to paid features requires an active subscription. Current plans and pricing are listed at lega.my/#pricing.

  • Subscriptions are billed monthly or annually in advance, in Malaysian Ringgit (MYR), via our payment partner CHIP
  • Subscriptions automatically renew at the end of each billing cycle unless cancelled before the renewal date
  • Pricing may change with at least thirty (30) days' notice, taking effect at your next renewal
  • Refunds, where applicable, are governed by our Refund Policy

5. Acceptable Use

Your use of the Service is subject to our Acceptable Use Policy, which is incorporated by reference into these Terms. Violations may result in suspension or termination without refund.

6. WhatsApp Connectivity Disclaimer

Lega connects to WhatsApp via the open-source Baileys library, which uses WhatsApp's unofficial multi-device protocol. Baileys is not endorsed, licensed, or supported by Meta Platforms, Inc.

You acknowledge and accept that:

  • Meta may at any time, and without notice, restrict, suspend, or permanently ban any WhatsApp number connected through the Service
  • Meta may modify the WhatsApp protocol in ways that disrupt or disable the Service's ability to connect
  • We do not guarantee uninterrupted connectivity to WhatsApp, and we are not liable for any business loss resulting from a WhatsApp ban, throttle, or protocol change
  • You should pair a dedicated business WhatsApp number with the Service, never your personal number
  • You are solely responsible for ensuring your messaging activity through the Service complies with WhatsApp's Business Policy and all applicable laws

7. Artificial Intelligence Features

The Service includes AI-powered features under two models:

  • Managed AI (default) — Lega routes AI requests through our own Anthropic API account. Usage is metered as "AI replies" against your plan's monthly allowance plus any one-time top-up packs you purchase. Top-up balances do not expire; monthly allowances reset each billing cycle. AI replies are deducted only on successful provider responses.
  • Bring Your Own Key (BYOK) — you supply your own API key from a supported provider (Anthropic, OpenAI, Google). BYOK is required for certain advanced features (such as knowledge base wizard and lead enrichment) where per-call cost falls outside the managed-tier model.

You acknowledge that:

  • AI-generated outputs may be inaccurate, incomplete, or inappropriate; you are responsible for reviewing them before they are sent to customers, or for accepting the risk of fully-automated replies
  • Under Managed AI, message content is transmitted to Anthropic via Lega's API account; under BYOK, content is transmitted to the provider you have selected using your key. Either way, the provider's privacy and data handling terms apply to that content
  • Under BYOK, you bear the cost and responsibility of usage charges from your chosen AI provider directly
  • AI providers may modify their models, pricing, or terms, which may affect the behaviour of the Service. We may adjust managed-tier replies-per-pack and per-plan allowances with reasonable notice if upstream costs change materially
  • We are not liable for any losses arising from AI outputs, including but not limited to incorrect customer information, missed orders, mis-quoted prices, or reputational harm

8. Customer Data Ownership

You retain all rights to the data you store in the Service, including end-customer messages, contacts, and lead records ("Customer Data"). You grant us a limited, non-exclusive licence to host, process, and display Customer Data solely for the purpose of providing the Service to you.

You warrant that you have a lawful basis to collect, store, and process the Customer Data through the Service, including all personal data of your end customers, in accordance with the Personal Data Protection Act 2010 (Malaysia) and any other applicable law. You agree to indemnify us against any claim arising from your unlawful collection or processing of Customer Data.

9. Intellectual Property

The Service, including all software, design, content (excluding Customer Data), trademarks, and logos, is the property of Polygon Technology Solutions or its licensors. You are granted a limited, non-exclusive, non-transferable licence to use the Service strictly in accordance with these Terms.

You may not:

  • Copy, modify, distribute, sell, or lease any part of the Service
  • Reverse-engineer, decompile, or attempt to extract the source code of the Service
  • Use the Service to build a competing product
  • Remove or obscure any proprietary notices

10. Service Availability and Changes

We strive to keep the Service available 24/7 but do not guarantee uninterrupted operation. We may perform scheduled maintenance, deploy updates, or experience unplanned downtime. We may also add, modify, or discontinue features. Material feature removals will be announced with at least thirty (30) days' notice where reasonably possible.

11. Suspension and Termination

We may suspend or terminate your account, with or without notice, if you:

  • Breach these Terms or the Acceptable Use Policy
  • Fail to pay subscription fees
  • Engage in activity that risks the security, stability, or legal standing of the Service or its users
  • Are required by law, court order, or regulatory authority to be suspended

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing cycle. See the Refund Policy for details on prorated refunds.

12. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any AI output or auto-reply will be accurate.

13. Limitation of Liability

To the maximum extent permitted by law, Polygon Technology Solutions, its officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities, arising out of or in connection with your use of the Service.

Our total aggregate liability to you for any claim arising out of or in connection with the Service shall not exceed the total subscription fees paid by you to us in the twelve (12) months immediately preceding the event giving rise to the claim.

14. Indemnification

You agree to indemnify, defend, and hold harmless Polygon Technology Solutions and its affiliates from any claim, liability, damages, or expense (including reasonable legal fees) arising out of:

  • Your use of the Service in violation of these Terms or the Acceptable Use Policy
  • Your unlawful collection, storage, or processing of Customer Data
  • Your violation of any third-party rights, including WhatsApp's Terms of Service or any privacy law
  • Content you transmit through the Service

15. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Malaysia. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Kuala Lumpur, Malaysia.

16. Changes to These Terms

We may update these Terms from time to time. We will post the updated version with a revised "Last Updated" date. For material changes, we will notify account holders by email at least fourteen (14) days before the change takes effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

17. Severability and Entire Agreement

If any provision of these Terms is held unenforceable, the remaining provisions shall remain in full force. These Terms, together with the Privacy Policy, Refund Policy, and Acceptable Use Policy, constitute the entire agreement between you and Polygon Technology Solutions regarding the Service.
